Battleship OS Terms of Service

1. Acceptance of Terms
By purchasing, downloading, installing, or using Battleship OS, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Battleship OS.
2. License Grant
Your purchase grants you a personal, non-exclusive, non-transferable license to use Battleship OS subject to the following conditions:
- You may install and use Battleship OS on one (1) computer at a time.
- Your license is bound to your hardware through a cryptographic hash generated from your computer's hardware attributes (CPU, memory, storage). This hash is sent to our server to verify your license. We cannot identify your specific hardware from this hash.
- You may transfer your license to new hardware up to 2 times per calendar year via your account at battleshipos.com/account.
- The license is perpetual and does not expire as long as you comply with these Terms.
3. Updates
"Lifetime updates" means:
- You will receive software updates, security patches, and new features for as long as Battleship OS is actively developed and maintained.
- If Battleship OS ceases active development, the last released version will remain fully functional on your computer.
- We may change what updates include, but will not remove functionality you already have.
- Updates are delivered through the Battleship OS package repository and require a valid license key after the grace period.
4. Grace Period
- New installations have a 30-day grace period with full update access.
- After 30 days, a valid license key is required for continued updates.
- The operating system continues to function without a license key; only access to updates is affected.
5. Refund & Withdrawal Policy (EU-Compliant)
For EU/EEA customers:
- You have a 14-day right of withdrawal under the EU Consumer Rights Directive.
- By checking the consent box at checkout, you agree that digital content delivery begins immediately and acknowledge that you waive your right of withdrawal once the license key is delivered to you.
- If you have NOT activated your license key, you may request a refund within 14 days of purchase by contacting support@battleshipos.com.
For all customers:
- Refunds are processed via Stripe to the original payment method within 5-10 business days.
- Once a license key has been activated, it is non-refundable except as required by applicable consumer protection law.
6. Open Source Components
- Battleship OS includes open-source software licensed under various licenses including GPL, LGPL, MIT, Apache, and others.
- These components are governed by their respective licenses, not these Terms.
- Source code for GPL-licensed components is available upon request at support@battleshipos.com.
- A complete list of open-source components and their licenses is available in the
/usr/share/doc/battleship-os/copyright file on your system.
- Proprietary components (Security Panel, First Boot Wizard, Captain, and other custom applications) are covered by these Terms.
7. Restrictions
You may NOT:
- Redistribute, sublicense, or resell Battleship OS or your license key.
- Circumvent, disable, or tamper with the license verification system.
- Use Battleship OS for any illegal purpose or in violation of applicable laws.
- Reverse engineer proprietary components except as permitted by applicable law.
- Use a single license on multiple computers simultaneously.
8. Limitation of Liability
Battleship OS is provided "as is" to the maximum extent permitted by law.
- We make no warranties, express or implied, regarding fitness for a particular purpose, merchantability, or non-infringement.
- We are not liable for data loss, hardware damage, lost profits, or any indirect, incidental, or consequential damages.
- Our total liability shall not exceed the purchase price you paid ($49).
- For EU consumers: This limitation does not affect your statutory rights under consumer protection law. You retain all rights that cannot be waived under EU law, including rights related to defective products.
9. Termination
- We may revoke your license if you violate these Terms, including but not limited to redistribution of license keys or circumvention of license verification.
- You may stop using Battleship OS at any time.
- Revocation does not entitle you to a refund except as required by applicable consumer protection law.
- Upon termination, you must cease all use of Battleship OS and its proprietary components.
10. Dispute Resolution
- These Terms are governed by the laws of [State/Country — TBD], without regard to conflict of law principles.
- For EU consumers: You retain the right to bring claims in the courts of your local jurisdiction under EU consumer protection law.
- Any disputes shall be resolved through binding arbitration or in the courts of [Jurisdiction — TBD], except where prohibited by law.

- We may update these Terms from time to time.
- Material changes will be communicated via the Battleship OS website at battleshipos.com.
- Continued use of Battleship OS after changes are posted constitutes acceptance of the updated Terms.
- If you do not agree to updated Terms, you may cease using Battleship OS but remain bound by the Terms in effect at the time of your purchase for the license already granted.
